Terms of Use

By downloading or using FogTrail you agree to these terms. If you do not agree, do not use the app.

Licence

FogTrail is licensed, not sold, to you for personal, non-commercial use on Apple devices you own or control, under Apple's standard Licensed Application End User Licence Agreement, which these terms supplement.

Who may use FogTrail

FogTrail is for people aged 13 or older. If you are under 19 (the age of majority in British Columbia), you may use FogTrail only with the permission of a parent or legal guardian, who accepts these terms with you and is responsible for your use, including any purchase made with their Apple Account and any place you walk to. Do not create an account if you are under 13; if we learn that someone under 13 has one, we will delete it. Parents and guardians can use Apple's Screen Time and Ask to Buy controls, and can delete a child's account in the app (Me → Settings & privacy → Delete account) or by emailing us. FogTrail Pro — auto-renewing subscription

FogTrail is free to download and free to walk with. FogTrail Pro is an optional auto-renewing subscription that unlocks keeping more than one walk as a place of your own, writing your own hint, adding your own still, and sending a place as a FogTrail file. Receiving a place someone sends you is always free, and so is everything else in the app.

Prices are in US dollars and are shown in your own currency, at Apple's local price for your storefront, on the subscription screen in the app before you buy. Payment is charged to your Apple Account at confirmation of purchase.

The subscription renews automatically. It renews at the same price for the same period unless you cancel it at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within the 24 hours before the period ends. You can manage your subscription and switch off auto-renewal in Settings → Apple Account → Subscriptions at any time, including during a free trial.

If a free trial is offered and you subscribe, any unused part of the trial is forfeited when you buy that subscription. A free trial converts into a paid subscription at the end of the trial period unless you cancel at least 24 hours before it ends.

Purchases, renewals, cancellations and refunds are handled by Apple under Apple's Media Services terms, not by us; we cannot process a refund on Apple's behalf. To request one, use reportaproblem.apple.com. Purchases restore to the same Apple Account through Restore Purchases on the subscription screen or in Me → Settings & privacy.

We may change the features included in FogTrail Pro or the price of a plan. Apple notifies you of a price increase and, where required, asks for your consent before it takes effect; you may cancel instead.

Signing in

Signing in is optional and creates a FogTrail account. You may sign in with Apple or Google; “Continue with email” creates no account at all, and the address you type there is used to suggest a walker name and is not saved. The account holds your walker name and avatar colour — and, if you signed in with Google, the email address Google provides alongside your name, which it does not offer separately. No walking data of any kind is stored there. Skipping sign-in costs you nothing in the app, which is fully usable signed out. You may delete the account at any time in Me → Settings & privacy → Delete account; deletion is permanent and we keep no backup. See the Privacy Policy.

Places you make and send

A place you keep, the hint you write, the photo you attach and the file you send are yours. You are responsible for what you put in them and for who you send them to: a FogTrail file carries the real name and the real line of the place, and the fog is enforced by the recipient's app rather than by cryptography. Do not put another person's private location, another person's photograph, or anything unlawful into a place, and do not send one to someone the ground is not safe for. Files travel directly between phones through Messages, AirDrop, Mail or Files — we never receive them, cannot see them, and cannot recall, moderate or delete one for you.

Privacy Zones and backups. A Privacy Zone you set keeps the protected area out of the place files and Fogprint pictures you share, but it is a convenience, not a guarantee: you remain responsible for checking what you send. A backup file keeps your full routes, including protected areas, and is not encrypted by FogTrail; keep it private. Do not use FogTrail to follow, locate, harass or pressure another person, and do not send a place to anyone who has not asked for it.

Not navigation, not safety equipment

FogTrail is an activity and discovery app. It is not a navigation system, a mapping authority, a fitness or medical device, or an emergency service. Routes, distances, elevation figures, difficulty ratings, surface and amenity descriptions, notes and images in the app are illustrative examples generated for the product — they are not surveyed data and must not be relied on to plan or follow a route. You are responsible for your own walk

Walking, hiking and being outdoors carry real risk, including of serious injury or death. You are solely responsible for deciding whether a place is safe for you, for checking conditions and closures with the authority that manages the land, for your own equipment and preparation, and for obeying all posted rules, private property and access restrictions. Do not use the app while walking on terrain that requires your attention.

Seeded example content

The circle of walkers in the app (Mara, Jun, Tess, Nico) is a local demo created by the app on your device. They are not real people, their step totals and rankings are invented, and hiding a place "for" one of them simply makes a fogged copy on your own phone — nothing is transmitted. The app says so on the Circle tab and in Settings. Sending a place to a real friend is a different action: it hands a file to iOS's share sheet, and you choose where it goes.

Health and step data

Step, distance and elevation figures are estimates from consumer sensors and from Apple Health. They may be inaccurate. Nothing in FogTrail is medical advice or a diagnosis. Consult a qualified professional about your health.

No warranty

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any injury, loss or damages arising from your use of the app or from any activity you undertake after using it, including reliance on any route, rating, description, image or figure shown in it, or on the app continuing to record while your phone is locked. Nothing in these terms limits liability that cannot be limited by law, and nothing limits your rights under British Columbia consumer protection legislation.

Ending your use

You can stop at any time by deleting your account and the app. We may suspend or end an account, or stop offering a feature, if it is used in breach of these terms or to put anyone at risk. Sections that by their nature should survive (including the safety, no-warranty and liability sections) do.

Ownership

FogTrail, its design, artwork and code belong to us and our licensors; you receive only the licence above. Your walks, places, hints and photos remain yours. We do not receive them, so we do not claim any right to them.

Governing law

These terms are governed by the laws of British Columbia and the applicable laws of Canada, without regard to conflict-of-law rules.

Changes

We may update the app and these terms. Continued use after an update means you accept the revised terms.
